PAGASI Terms of Use

These Terms of Use explain the rules and responsibilities that apply when using PAGASI and its referral platform.

1. Acceptance of Terms

By creating an account, accessing, or using PAGASI, you agree to these Terms of Use, the Privacy Policy, and any other policies published by PAGASI. If you do not agree, you must not use the platform. You confirm that you are at least the age of majority in your province or territory, or that you have the legal authority to use the platform.

2. What PAGASI Is

PAGASI is a technology platform that connects users with participating businesses and professionals. PAGASI is not: • a dealership • a real estate brokerage • a mortgage brokerage • an insurance brokerage • a lender • a law firm • an accounting firm • an immigration consultant • a financial institution PAGASI only facilitates introductions between users and independent businesses. All services are provided by the business selected by the user.

3. No Guarantee

PAGASI does not guarantee: • loan approval • mortgage approval • insurance approval • financing approval • vehicle availability • home availability • pricing • promotions • referral rewards • appointment availability Each participating business makes its own independent decisions.

4. User Responsibilities

Users agree to: • provide truthful information • keep account information updated • protect login credentials • use PAGASI legally • avoid fraudulent activity • avoid creating duplicate accounts • avoid impersonating others • avoid submitting false referrals Users are responsible for all activity under their account.

5. Referral Rewards

Referral rewards are promotional incentives. Rewards are earned only after: • the referred customer completes the qualifying transaction • the business confirms the referral • any cancellation period has passed • PAGASI verifies eligibility PAGASI may delay payment while verification is underway. Rewards may be cancelled if: • information is inaccurate • duplicate referrals occur • fraud is suspected • self-referrals occur • transactions are cancelled • refunds occur • the partner rejects the referral PAGASI has the right to investigate any reward before payment.

6. Taxes

Users are solely responsible for determining and paying any taxes related to rewards received through PAGASI. Where required by applicable law, PAGASI may collect tax-related information before issuing payments. Failure to provide legally required information may delay or prevent payment.

7. Identity Verification

PAGASI may request identity verification before: • paying rewards • preventing fraud • complying with legal obligations Failure to complete verification may result in: • payment delays • account suspension • account termination

8. Matching System

PAGASI uses automated matching based on information including: • location • language • preferred dialect • service requested • preferences • partner availability Matching results are recommendations only. Users may choose any participating partner. PAGASI does not guarantee the quality, suitability, or outcome of any recommendation.

9. Communications

Users agree that PAGASI and participating businesses may contact them through: • phone • email • SMS • in-app messages • Messenger • WhatsApp, where available Users may opt out of marketing communications while still receiving service-related notifications.

10. Business Independence

Businesses listed on PAGASI are independent companies. PAGASI is not responsible for: • pricing • contracts • negotiations • financing decisions • warranties • service quality • delays • cancellations All agreements are solely between the customer and the business.

11. Reviews

Users agree to provide honest reviews. PAGASI may remove reviews that are: • false • defamatory • abusive • discriminatory • spam • unrelated PAGASI is not responsible for opinions expressed by users.

12. User Content

Users retain ownership of submitted content. By uploading content, users grant PAGASI a non-exclusive, worldwide, royalty-free license to use, display, and process the content solely for operating, improving, and promoting the platform. Users confirm they own or have permission to upload the content.

13. Prohibited Activities

Users may not: • commit fraud • manipulate referrals • create fake accounts • create fake reviews • upload malware • harass others • violate intellectual property rights • attempt unauthorized access • interfere with platform operations • misuse referral programs Violations may result in immediate suspension.

14. Suspension

PAGASI may suspend or terminate accounts for: • fraud • policy violations • abuse • illegal activity • security risks • repeated complaints PAGASI may withhold unpaid rewards while investigations are ongoing.

15. Privacy

Personal information is handled according to the Privacy Policy. Information may be shared with matched businesses solely for providing requested services.

16. Intellectual Property

The PAGASI name, logo, software, design, trademarks, and content remain the exclusive property of PAGASI unless otherwise stated. Users may not copy, modify, or distribute PAGASI materials without written permission.

17. Limitation of Liability

To the maximum extent permitted by law, PAGASI is not liable for: • indirect damages • lost profits • lost opportunities • business interruption • data loss • referral disputes • partner conduct • service outcomes PAGASI's total liability shall not exceed the amount paid directly by the user to PAGASI during the previous twelve months, or CAD $100 if no payment was made. Some jurisdictions may not allow certain liability limitations, so these limitations apply only to the extent permitted by law.

18. Indemnification

Users agree to indemnify and hold harmless PAGASI, its owners, employees, contractors, affiliates, and partners from claims, damages, liabilities, losses, costs, and reasonable legal fees arising from: • misuse of the platform • violation of these Terms • infringement of another person's rights • fraudulent or unlawful activity by the user

19. Disclaimer

The platform is provided "as is" and "as available." PAGASI makes no warranties regarding: • uninterrupted availability • error-free operation • business results • financial outcomes • suitability for any purpose

20. Force Majeure

PAGASI is not responsible for delays or failures caused by events beyond its reasonable control, including natural disasters, government actions, labor disputes, internet outages, cyberattacks, pandemics, or failures of third-party providers.

21. Arbitration and Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Before starting court proceedings, both parties agree to make a good-faith effort to resolve disputes through negotiation. Where permitted by law, unresolved disputes may be submitted to binding arbitration in Alberta. Nothing in this section limits rights that cannot legally be waived under applicable consumer protection laws.

22. Changes to Terms

PAGASI may update these Terms from time to time. Material changes will be communicated through the app or other appropriate means. Continued use of the platform after changes become effective constitutes acceptance of the updated Terms.
